Solutech Limited (“We”, “Our” or “us”) is committed to protecting your privacy. This Privacy Policy describes our policies and procedures on the collection, use and disclosure of Your information when You use our mobile applications (Solutech SAT, Solutech SAT Admin, Kodie, Dukasoft, KaziTime and Solutech CRM) and tells you about your privacy rights and how the law protects You.

We use Your Personal Data for administrative purposes and to facilitate accomplishment of various business processes. By using our Application(s), You agree to the collection and use of information in accordance with this Privacy Policy.

Definition of Terms

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:

  1. Service refers to the solutions provided by Solutech Limited as described in the relative terms (if available) and on this platform.
  2. Company: When this policy mentions “Company”, “We”, “Us” or “Our”, it refers to Solutech Limited, 3rd Floor BOA House School Lane, Westlands, Nairobi that is responsible for your information under this Privacy Policy.
  3. You, means the individual consuming the Service, the Company, legal entity on behalf of which such individual is accessing or using the Service, as applicable.
  4. Account is the identity created for You to access our Service or parts of our Service.
  5. Application means the mobile applications provided by the Company downloaded by You on any electronic device.
  6. Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to the third party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
  7. Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself.
  8. Country: where the Company is based, in this case, Kenya.
  9. Customer: refers to the company, organization or person that signs up to use the Application(s) to manage the relationships with your consumers or service users.
  10. Device: Any internet connected device such as a mobile phone, tablet, computer or any other device that can be used to visit Applications published by the Company and use the Services. 
  11. IP address: Every device connected to the internet is assigned a unique number known as an Internet Protocol (IP) address. These numbers are usually designed in geographic books. An IP address can often be used to identify the location from which a device is connecting to on the internet. 
  12. Personnel refers to individuals who are employed by Solutech Limited or are under contract to perform a service on behalf of one of the parties.
  13. Personal Data refers to any information that directly, indirectly or in connection with other information – including a personal identification number- allows for the identification of identifiability of a natural person.
  14. Third-party service: refers to advertisers, contest sponsors, promotional and marketing partners and others who provide our content or whose products or services we think may interest you.
  15. Website: Solutech Limited’s website which can be accessed using this URL
  16. Cookie: Small amount of data generated by a website and saved by your web browser. It is used to identify your browser, provide analytics and remember information about you such as your language preference or login information.

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data

When using our Service, We may ask You to provide Us with certain Personally Identifiable Information that can be used to contact or Identify You. Personally Identifiable Information may include, but is not limited to:

  1. Name
  2. Phone number

  4. Password
  5. ID number

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device’s IP address, device model, battery status, application version, date and time you login to your Account, unique device identifiers, mobile Operating System and other diagnostic data. We also collect information from mobile devices for a better user experience.

Information Collected while Using the Application

While using our Application, in order to provide features of Our Application, we may collect with your permission:

  1. Information regarding your location.
  2. Pictures and other information from your Device’s camera and photo library.
  3. Device information.
  4. IP address

Any of the information we collect from you may be used in one of the following ways:

  1. To personalize your experience (your information helps us to better respond to your individual needs).
  2. To improve our services (we continually strive to improve our service offerings based on the information and feedback we receive from you).
  3. To improve customer service (your information helps us to more effectively respond to your customer service requests and support needs).
  4. For security and compliance purposes with the aim of safeguarding your privacy.
  5. To process transactions.
  6. To administer surveys or other site features.
  7. To send periodic emails.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  1. To manage Your Account: The Personal Data You provide can give you access to different functionalities of the Service that are available to You as a registered user.
  2. For the performance of a contract: The development, compliance and achieving the objective that the respective Application sets to achieve.
  3. To contact You: To contact You by email, telephone calls, SMS or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including security updates, when necessary or reasonable for their implementation.
  4. To manage Your requests: To attend and manage Your requests to Us.

Sharing Your Personal Data

We may share your personal information in the following situations:

  1. For business transfers: We may share or transfer your personal information in connection with or during negotiations of any merger, sale of Company assets, financing or acquisition of all or a portion of Our business to another company.
  2. With business partners: We may share Your information with Our business partners to offer You certain products or services.
  3. With Your Consent We may disclose Your personal information for any other purpose.

Sharing Information With Third Parties

We may share the information that we collect both personal and non-personal with third- parties who may further process your data to provide you with services that you may need. We may also share it with our current and future affiliated companies, and if we are involved in a merger asset sale or other business reorganization, we may also share or transfer your personal and non-personal information to our successors-in-interest.

We may engage trusted third party service providers to perform functions and provide services to us, such as hosting and maintaining our servers and our service, database storage and management, email management, storage marketing and customer service. We will likely share your personal information, and possibly some non-personal information, with these third parties to enable them to perform these services for us and for you.

We may share portions of our log file data, including IP addresses for analytics purposes with third parties, security and analytics purposes. if your IP address is shared, it may be used to estimate general location and other technographics such as connection speed and type of device used to consume the service. They may aggregate information and then provide auditing and reporting services for us.

Updating Your Personal Data

The rights you have to request updates or corrections to the information we collect depends on your relationship with us. Customers have the right to request the restriction of certain uses and disclosures of personally identifiable information as follows. You can contact us in order to:

  1. Update or correct your Personally Identifiable Information.
  2. Change your preferences with respect to communications and other information you receive from us.
  3. Delete the Personally Identifiable Information maintained about you on our systems (subject to the following paragraph), by canceling your account, such updates, corrections, changes and deletions will have no effect on other information that we maintain or provided to third parties in accordance with this Privacy Policy prior to no such update, correction, change or deletion.

To protect your privacy and security, we may take reasonable steps (such as requesting a unique password.) to verify your identity before granting you access to your profile or making corrections. You are responsible for maintaining the secrecy of your unique password and account information at all times. You should be aware that it is not technologically possible to remove each and every record for the information at all times. The need to back up our systems to protect information from inadvertent loss means that a copy of your information may exist in a non-erasable form that will be difficult or impossible to locate. Promptly after receiving your request, all personal information stored in databases we actively use and other readily searchable media will be updated, corrected, changed or deleted as appropriate or as soon as and to the extent reasonably or technically practicable. If you are an end user and wish to update, delete or receive any information that we have about you, you may do so by contacting the organization of which you are a customer.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes and to enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Downloading of your Data

As part of our commitment to transparency and your control over your personal information, we provide you with the ability to export a copy of the data we have collected about you. This feature allows you to access and review the information we hold, empowering you to ensure its accuracy and make informed decisions about your privacy.

To initiate a data download request, please place a request on the settings page of the application that you are using. We will process your request promptly, and upon verification of your identity, we will email you with a downloadable file containing the personal data associated with your account.

Please note that certain limitations and restrictions may apply, and not all data may be available for download due to technical constraints or legal requirements. 

By exercising your right to download your data, you acknowledge and agree that you have read and understood our privacy practices outlined in this policy.

Further Processing of your Data

Within the scope of our services, personal data may be subjected to automated decision-making processes. It is important to note that while we strive to employ advanced technologies responsibly, we do not guarantee the outcome or actions resulting from automated decisions made by the business.

We are incorporated in Kenya. Information collected via our website, through direct interactions with you, or from use of our help services may be transferred to our offices or personnel, third parties located throughout the world, including countries that may not have laws of general applicability regulating the use and transfer of such data. To the fullest extent allowed by applicable law, by using any of the above, you voluntarily consent to the trans-border transfer and hosting of such information.

Deletion of Your Personal Data

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You. Our Service may give You the ability to delete certain information about You from within the Service.

You may update, amend or delete Your information at any time by sending a request to your service administrator in Solutech SAT and SAT admin or by signing in to your account and visiting the account settings section that allows you to manage Your personal information that you have provided to Us.

Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition and asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law Enforcement

We may also disclose personal and non-personal information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate in order to respond to claims, legal process (including subpoenas), to protect our rights and interest or those of a third party, the safety of the public or any person, to prevent or stop any illegal, unethical or legally actionable activity or to otherwise comply with applicable court orders, laws, rules and regulations.

The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

All supplied sensitive information is transmitted via Secure Socket Layer (SSL) technology. We cannot however ensure or warrant the absolute security of any information you transmit to us or guarantee that your information on the Service may not be accessed, disclosed, altered or destroyed by a breach of any physical, technical or managerial safeguards.

Sale of Business

We reserve the right to transfer information to a third party in the event of a sale, merger or other transfer of all or substantially all of the assets of us or any of its future Corporate Affiliates or that portion of us or any of its future corporate affiliates to which the service relates or in the event that we discontinue out business or file a petition or have filed against us a petition in bankruptcy, reorganization or a similar proceeding, provided that the third party agrees to adhere to the terms of this Privacy Policy.

Governing Law

The laws of Kenya, excluding its conflicts of law, shall govern this Agreement and your use of our service. Your use of our service may also be subject to other local, state, national or international laws.

Your Consent

By using Solutech’s Applications, you confirm that you have read and understood this Privacy Policy and you consent to this Privacy Policy.

Children’s Data

We do not address anyone under the age of 18. We do not knowingly collect Personally Identifiable Information under the age of 18. If we become aware that we have collected personal data from anyone under the age of 18 without verification of parental consent, we take steps to remove that information from our servers.

Changes to our Privacy Policy

If we decide to change our privacy policy, we will post those changes on this page, and/or update the Privacy Policy modification date below.

Third-Party Services

We may display, include or make available third-party content (including data, information applications and other products services) or provide links to third-party websites or services.

You acknowledge and agree that we shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other person or entity for any Third-Party Services.

Third-party Services and links thereto are provided solely as a convenience to you and you access and use them entirely at your own risk and subject to such third parties’ terms and conditions.

Tracking Technologies

Google Maps APIs

Google Maps API is a robust tool that can be used to create a custom map, a searchable map, check in-functions, display live data syncing with location, plan routes or create a mashup just to name a few.

Google Maps API may collect information that is held in accordance with its Privacy Policy.

Cookies

We use “Cookies” to identify the areas of our website that you have visited. A cookie is a small piece of data stored on your computer or mobile device by your web browser. We never place Personally Identifiable Information in Cookies.

Individual Data Subject’s Rights – Data Access, Portability and Deletion

We are committed to helping our customers meet the data subjects rights requirements of the Data Protection Act (DPA) of 2019. Solutech SAT processes or stores all personal data in fully vetted, DPA compliant vendors. We do store all personal data for up termination of contract with the user and data is destroyed upon contract termination in accordance with the Terms of Service and Privacy Policy, but we will not hold it longer than 60 days.
